These terms govern the sale of trailers, spares and services by TRAILERS SA to buyers in South Africa and, where applicable, cross-border. They are written to be read, not to be survived.
1. Who you are contracting with
TRAILERS SA, Company Registration Number 2015/077106/07, VAT Number 4060277664, of 1 Dwars St, Hartswater, 8570, Northern Cape, South Africa. Contact: sales@trailerssa.co.za, +27 68 145 9358. In these terms “we”, “us” and “our” mean TRAILERS SA, and “you” means the buyer.
2. Quotes and orders
A quote is an invitation to do business, not a binding contract, and is valid for the period stated on it. Where no period is stated, a quote is valid for 14 days from issue. Prices may change after that, mainly because steel prices do.
A contract of sale comes into existence when we accept your order and receive the agreed payment or deposit. We may decline an order, including where a product is mispriced, out of stock, or where we cannot lawfully supply to the destination.
3. Prices, VAT and payment
All prices shown on this website are in South African Rand and include VAT at 15 percent. A full tax invoice bearing our VAT number is issued on payment.
Stock units are payable in full before the trailer leaves our works. Custom builds are payable by deposit with the balance due on completion, in the proportions set out on your quote. Ownership of the goods passes to you only on receipt of full payment in cleared funds. Risk in the goods passes to you on delivery or on collection, whichever happens first.
4. Delivery and collection
Delivery is free anywhere in South Africa on orders over R20,000 with code TSA26 applied at checkout. Below that threshold delivery is quoted per destination. Collection from our Hartswater works is free on any order. Full detail is on the shipping policy page.
Delivery dates are given in good faith and confirmed in writing at order. We are not liable for delay caused by events outside our reasonable control, including weather, road closures, border delays, industrial action, load shedding or supplier failure.
5. Specifications
We reserve the right to improve a design and to substitute a component of equal or better specification. Where a substitution materially changes what you ordered, we will tell you before we order it.
Photographs and renders on this website illustrate the product type. Fittings shown may be optional extras. The written specification on your quote is the one that governs the sale.
6. Your obligations as owner
You are responsible for registering and licensing the trailer in your name, for obtaining a roadworthy certificate where required, for ensuring your driver holds the correct licence code for the combination, and for loading the trailer within its rated gross vehicle mass. Overloading is dangerous, it is unlawful, and it voids warranty cover.
7. Warranty
The builder warranty, which we administer on your behalf, covers manufacturing defects in chassis, welds, workmanship and tank fabrication, and excludes wear items, overloading, accident damage, unauthorised modification and neglected maintenance. 8. Your rights under the Consumer Protection Act
Nothing in these terms limits any right you have under the Consumer Protection Act 68 of 2008, including the implied warranty of quality under section 56 and the right to return goods that are defective or unfit for their intended purpose within six months of delivery. Where these terms conflict with the Act, the Act prevails.
9. Returns and cancellation
Returns, cancellations and refunds are dealt with on the returns and refunds page. In short: defective goods are your right, a change of mind on a stock item is negotiable and may carry a handling charge, and a custom build made to your specification cannot be returned for a change of mind.
10. Liability
To the fullest extent permitted by law, and subject always to the Consumer Protection Act, our liability arising from any sale is limited to the price paid for the goods concerned. We are not liable for indirect or consequential loss, including loss of profit, loss of contract or downtime, however it arises.
11. Personal information
We process personal information in accordance with the Protection of Personal Information Act 4 of 2013. See the privacy policy for what we collect, why, and how to exercise your rights.
12. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. We would rather sort a problem out by phone than by letter, so raise it with us first. If it cannot be resolved that way, you may refer a consumer complaint to the National Consumer Commission or to a recognised consumer goods ombud. Nothing here removes your right to approach a court of competent jurisdiction.
13. Changes to these terms
We may update these terms. The version in force is the one published on this page on the date your order is accepted. Material changes will be noted here.
